Terms & conditions

The following Terms and Conditions form a legally binding agreement between the agent of Emex dwc (Agent) and Emex dwc (Company) in relation to the Emex dwc Agent Program (Program).

Company facilitates Agent program via its technology and network on the internet. Agent attract new customers to earn financial compensation (commission) as percentage of the purchases of attracted customers which they make through the Company website www.emexdwc.ae.

PLEASE TAKE A MOMENT TO READ THESE TERMS AND CONDITIONS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING LEGAL RIGHTS, REMEDIES AND OBLIGATIONS.

TO APPLY TO AND PARTICIPATE IN PROGRAM YOU MUST AGREE TO BE LEGALLY BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT BY CLICKING “I ACCEPT” WHERE INDICATED. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU HAVE NO RIGHT OR AUTHORITY TO APPLY TO AND PARTICIPATE IN OR EXERCISE ANY OTHER RIGHT IN CONNECTION THEREWITH.

Application of Terms

1.1 These Terms apply to your application to, or participation in the Program.

1.2 You may not apply to, or participate in, the Program if you are not of legal age to form a binding contract with the Company, or are otherwise precluded from participating in the Program under the laws of the country in which you are resident.

1.3 These Terms shall be deemed accepted by you upon the earlier of your

(i) submitting an application to participate in the Program; or

(ii) continued participation in the Program.

1.4 Emex dwc may make changes to the Terms from time to time. You will be informed about changes by email as well as on our website. If you continue to participate in the Program after the date on which the Terms have changed, you are deemed to have affirmatively accepted the updated Terms. If you decide to leave the Program following any changes, the only solution is to terminate your participation in the Program in writing by email to the Emex dwc customer support team sales@emexdwc.ae.

Enrolment

2.1 A potential Agent must submit a complete application in agent account on Emex dwc website.

2.2 Agents are not permitted to open more than one Agent account on the Emec dwc Agent Program

2.3 The Company will evaluate the application and notify the potential Agent of their acceptance or rejection to the Program.

Term and Termination

3.1 These Terms shall remain in full force and effect for the whole time during which you participate in the Program.

3.2 The Company may terminate your participation in the Program at any time with 7 days prior notice, if you breach any of these Terms, except in instances of gross misconduct where an affiliate will be immediately removed. Any instant removals will be discussed with the relevant network to confirm an agent conduct warrants such action.

3.3 Immediately upon your ceasing to participate in the Program for whatever reason, you shall return to the Company any confidential information, and all copies of information in your possession, custody and control. You will cease all uses of any trade names, trademarks, service marks, logos and other designations of the Company or its licensors.

3.4 The termination of your participation in the Program will not relieve you of any liability arising from any breach of these Terms occurring prior to such termination.

Agent Obligations and Responsibilities

4.1 Agent shall only engage in attracting customers, advertising, marketing and promotional efforts which do not violate any law, and which reflect positively upon the business reputation of the Emex dwc brand.

4.2 Agent shall not establish any social network profiles or domains, a blog domain, profile name or display name containing Emex dwc or any variation.

4.3 Furthermore, agents operating within social environments must communicate under their Agent names so there is clarity that they are not misrepresenting themselves as Emex dwc and so that customers understand they operate separately to Emex dwc.

4.4 If agents post on an existing community website with reference to Emex dwc, they must be open to community members that they are an agent for Emex dwc.

4.5 If an agent receives any complaints from customers regarding Emex dwc services or products, they should not respond and instead agree to forward the complaint via email to Emex dwc support team sales@emexdwc.ae within 24 hours.

Commission

5.1 Agent will be assigned a unique promotional code (promocode) upon registration. Each customer you attracted must indicate this promotional code when registering on the Emex dwc website. This code will be used to calculate yours commission

5.2 The Company has the right to determine the rate of commission payable and the terms on which it is payable, in its absolute discretion.

5.3 The Company shall notify the Agent of the rate of commission payable via:

(i) the Company’s website;

(ii) email to the Agent

5.4 The commission is paid once a month if it exceeds $ 50 (threshold). Amounts below the payment threshold will be added to the commission for the next billing cycle.

5.5 The company transfers the commission to the PayPal account of the Agent https://www.paypal.com

5.6 No commission is payable in respect of:

 transactions without Agent’s promotion code;

 cancelled and returned orders;

 fraudulent transactions.

5.7 Agent shall be responsible for all applicable taxes
